Alexander Legkovs Medaillen sind sauber. CAS hebt lebenslange Sperre des Goldmedaillengewinners im 50 km Skilanglauf von Sochi 2014 auf. Insgesamt 28 russische Athleten haben Erfolg.

 

Alexander Legkov ist einer der 39 Athleten, die vor dem Court of Arbitration for Sport in Lausanne gegen die lebenslange Sperre geklagt haben, die die Oswald Kommission wegen der Vorgänge in Sochi 2014 gegen sie verhängt haben. Im Zentrum stehen die Aussagen des russischen „whistleblowers“ Dr Rodchenkov und der McLaren Bericht.

 

WIESCHEMANN | Rechtsanwälte haben Alexander Legkov seit dem 22.12.2106 in Verfahren vor dem FIS Anti Doping Panel, dem Court of Arbitration for Sport und der Disziplinarkommission des IOC und zuletzt wiederum vor dem CAS in einer dem längsten und größten Verfahren in der Geschichte des CAS vertreten. Wir sind glücklich, dass wir zusammen mit SCHELLENBERG Rechtsanwälte, die die anderen Athleten vertreten haben, am Ende die Unschuld des Athleten haben beweisen können, an die wir von Anfang an geglaubt haben.

 

Auch nach Erlass des operative part der Entscheidung gilt noch immer der Grundsatz der Vertraulichkeit des Verfahrens. Den respektieren alle Beteiligten. Was aus dem Inhalt des Verfahrens Gegenstand des Urteils und damit auch öffentlich wird, hat das panel in seiner Urteilsbegründung zu entscheiden, die wir abwarten werden.

 

Unsere Position sowohl zur Person von Dr. Rodchenkov, zur Beweisführung des IOC und auch zum report von Prof. McLaren haben wir in der Vergangenheit mehrfach deutlich gemacht. Sie finden die Informationen auf unserer homepage www.wieschemann.eu. Die Beweisaufnahme in dem Hearing vom 22.1. bis 27.1.2018 hat unsere Kritik bestätigt. Ausreichende Beweise, die auf eine Beteiligung der Athleten selbst hindeuten, sind und waren nicht vorhanden.

 

Die Verantwortlichen des IOC haben ihnen seit langem vorliegende Erkenntnisse, die wichtige Teile der Angaben von Dr Rodchenkov greifbar widerlegen, nie gewürdigt und ist weiteren Beweismitteln, die die Athleten hätten vom Verdacht befreien können, trotz unseres Antrages nicht nachgegangen. Das gilt auch für Prof. Mclaren, der nur Erkenntnisse gesucht hat, die die Angaben von Dr Rodchenkov unterstützen, nicht aber solche, die sie widerlegen könnten. Wesentliche Angaben von Dr Rodchenkov sind aber tatsächlich widerlegt.

 

Mit Rücksicht auf die weitere Athleten und die noch schwebenden Verfahren im Zusammenhang mit der Teilnahme an den Olympischen Spielen 2018 werden wir zunächst keine weiteren Erklärungen abgeben.

 

 

 

Alexander Legkov’s medals are clean. CAS lifts lifetime ban of gold medalist Sochi 2014 50km cross-country skiing. A total of 28 Russian athletes succeed.

 

Alexander Legkov is one of the 39 athletes who appealed in Lausanne against the life-long ban imposed on them by the Oswald Commission in connection with what happened in Sochi in 2014. The focus is on the statements of the Russian „whistleblower“ Dr Rodchenkov and the McLaren report.

 

Wieschemann | Lawyers represented Alexander Legkov since 22.12.2106 in proceedings before the FIS Anti Doping Panel, the Court of Arbitration for Sport and the Disciplinary Commission of the IOC Oswald Commission, and lastly before the CAS in one of the longest and largest proceedings in the history of the CAS. We are happy that together with SCHELLENBERG lawyers, representing the other athletes, we can prove the innocence of the athlete we believed in from the beginning.

 

Although the operative part of the decision is issued, the principle of confidentiality of the procedure still applies. I assume that all parties involved will respect this. The panel has to decide in its judgment what details of the proceedings becomes subject of the reasoning of the decision and therefore will also become public. We will wait for the reasoned decisions.

 

However, our position to the person of Dr. Rodchenkov, on the evidence of the IOC and also on the report of Prof. McLaren, we have repeatedly made clear in the past. Sufficient evidence to prove individual involvement of the athlete is not available and was never available.

 

Those who responsible for the IOC have never respected findings which are long standing in their possession that tangibly refute important parts of Dr Rodchenkov’s information, and they have not pursued further evidence that could have rid the athletes of their suspicions –  despite our request. This also applies to Prof. Mclaren, who has sought only findings that corroborate the information provided by Dr Rodchenkov, but not those that could refute them. However, essential information provided by Dr Rodchenkov is indeed refuted.

 

With regard to the other athletes and the pending procedures in connection with the participation in the Olympic Games 2018, we will give no further detailed explanation.
